FОP Guner Ersan, EDRPOU 2991019651, address: Ukraine, 08600, Kyiv Oblast, city of Vasylkiv, Decembrystiv Street, building 166-A, acting in accordance with Article 633 of the Civil Code of Ukraine, offers to an unlimited number of persons (hereinafter – the User(s)) to enter into the Public Offer Agreement (hereinafter - the Agreement), for the purpose of searching for and/or purchasing tickets using the website buslio.com (hereinafter – the Website) (hereinafter – BUSLIO).
The User may act within the scope of the Agreement in their own name and for their own benefit and/or on behalf of a third party and for its benefit; in such case the User acts exclusively within the powers granted by the third party.
BUSLIO is an integrated distributor of transportation services provided by carriers, bus stations, and third parties, hereinafter referred to as the Provider.
A Ticket (including an electronic ticket) - is a travel document of the established form, which grants the passenger the right to receive transportation services by bus transportation, created in the automated system of BUSLIO, sent to the e-mail address specified when placing the order or otherwise issued to the User.
The Ticket number is the number of the Public Offer Agreement and the number of the passenger transportation agreement.
The User and BUSLIO are aware of the general requirements for concluding Agreements, compliance with which is necessary for the validity of the transaction; having the full scope of civil legal capacity and civil legal standing, have the corresponding authority to enter into such transaction, fully aware of the meaning of their actions and in accordance with a free expression of will that corresponds to the internal will of the parties to this transaction, with the aim of the real occurrence of legal consequences, understanding the legal nature of this transaction, as well as their rights and obligations under the Agreement; in accordance with the applicable law, have entered into this Agreement for the following:
1. Subject of the agreement
1.1. Under the Agreement, BUSLIO provides services for searching for a suitable Provider, in accordance with the date, time and direction selected by the User, forming connections of different Providers, concluding a transportation agreement (by selling/purchasing a Ticket), issuing tickets of different Providers with one order, pre-sale of tickets, seat booking, ordering tickets by phone, reissuing a ticket, searching for the optimal schedule upon the User’s request, as well as prepayment of the Ticket by funds received from the User (hereinafter - Services).
1.2. For the Services provided, BUSLIO receives remuneration, which consists of a sum of funds included in the Ticket price and defined as the Agent remuneration (paid by the Provider) and the Service fee (paid by the User).
1.3. BUSLIO, acting as an agent, in the name of and at the expense of and in the interests of the Provider, using the website, sells bus passenger transportation (hereinafter - the Ticket), special offers, discounts and provides information of the Provider.
1.4. Each purchase of a Ticket from a separately selected Provider, is subject to the rules and conditions of that Provider and is an integral part of the Agreement.
1.5. In case of purchasing several Tickets with one order, the rules and conditions of one or another Provider may differ.
1.6. Failure to comply with the Provider’s and/or BUSLIO rules and conditions may result in the cancellation of orders and refusal to access the Website and/or purchased services, including the possibility to use the Ticket, without refunding the funds spent on purchasing it.
1.7. Purchasing a Ticket by the User under preferential terms (free transportation, etc.) in accordance with the legislation of Ukraine, is carried out exclusively at the ticket office/office of the relevant Provider, or with permission from the relevant Provider.
2. Rights and obligations of the parties
2.1. The User has the right to:
2.1.1. Receive services under the Agreement;
2.1.2. Use the Ticket, in accordance with the selected date, time, place of departure and selected Provider;
2.1.3. Return the Ticket under the conditions defined by the Provider and/or by BUSLIO;
2.1.4. Request compensation for losses incurred, arising from the terms of the Agreement, by sending an appropriate request to the address BUSLIO.
2.1.5. In case of causing non-pecuniary (moral) damage to the User, by actions or inaction of BUSLIO, the compensation amount, upon its proof and substantiation, may not exceed the amount greater than the cost of the Ticket.
2.1.6. The User, when the Providers require to carry out the exchange and/or return of the ticket exclusively at the ticket office of the bus station without the possibility to refund funds, through the website or at the partner’s office of BUSLIO where the payment was made, complies with the terms of such exchange and/or return stated in the Ticket.
2.2. The User is obliged to:
2.2.1. Make a prepayment of the Ticket, at 100% of the value stated on the website;
2.2.2. Verify the date, time, city/place of departure, city/place of arrival immediately after purchasing the Ticket;
2.2.3. Arrive at the place of departure in advance;
2.2.4. Notify BUSLIO of the impossibility of using the Ticket for one reason or another;
2.2.5. Become familiar with the Ticket return conditions;
2.2.6. Contact BUSLIO before the moment of payment of the Ticket, in case of absence of return conditions of the purchased Ticket of the selected Provider on the Website.
2.2.7. When buying a Ticket for two or more Providers or to the transfer point, using the Website, the User is obliged to independently determine a sufficient amount of time for making the transfer, including if such boarding is offered on the Website. The recommended number of hours of waiting at the transfer point is, for intrastate flights 4 hours, for interstate 8 hours from the time of arrival according to the schedule.
2.2.8. Become familiar with the rules and conditions of the selected Provider before purchasing the selected Provider’s ticket, thereby providing consent to perform and act in accordance with the Provider’s rules and conditions. Some Providers provide the possibility to determine the return conditions for a certain ticket only after purchasing it. Based on such specificity the User agrees that the withholding upon return of such ticket may equal 100% of the ticket’s value, even if the return is processed within the first minutes after its payment.
2.3. BUSLIO has the right to:
2.3.1. Act on behalf of the Provider, within the scope of powers defined by the contractual relationship;
2.3.2. Conclude a transportation agreement between the User and the Provider, on the terms and in the manner determined by the Provider;
2.3.3. Establish and receive additional remuneration from the User, for additionally provided services and/or services.
2.3.4. BUSLIO has the right to record telephone conversations with the User and/or the Passenger, in case of contacting BUSLIO and/or in case of servicing the User/Passenger and/or when it is necessary to notify the User/Passenger and/or obtain additional information in relation to any Ticket, made using the BUSLIO service and/or the Website.
2.4. BUSLIO is obliged to:
2.4.1. Notify the Provider about the purchased Ticket, and about the additional services paid by the User;
2.4.2. Send the Ticket to the User in accordance with the form established and accepted by the Provider;
2.4.3. Transfer the funds received from the User, as payment for the Ticket, to the settlement account of the Provider;
2.4.4. Notify the User about changes in the conditions of providing services (provided that such changes are notified by the Provider);
2.4.5. Notify the User about the change or cancellation of a route (in case such information is received from the Provider);
2.4.6. Accept requests from the User, consider it independently or forward it for consideration to the respective Provider;
2.4.7. Timely notify the User about consideration of the request, and in case of sending the request to the Provider, about the results of its consideration (if such reply is received at the address BUSLIO).
2.5. BUSLIO provides a response to requests, in a manner similar to the manner in which they are received. Sending a response to a third party (including at the User’s request) will not be carried out.
3. Settlements
3.1. Funds received from the User, as payment for the purchase of the Ticket, belong to the Provider (except for the BUSLIO Service fee (if such was included in the Ticket price). BUSLIO performs settlement for the Ticket purchased by the User on the terms and within the time periods determined by the Provider.
3.2. The User is solely responsible for all commission expenses and other expenses defined by the bank, which may be added to the price of the Ticket or additional services, by the issuer of a credit or debit card, except for cases, in which the expenses are assigned to BUSLIO’s responsibility.
3.3. Bank services related to the transfer of funds within the scope of the Agreement are paid by the Party that carries them out.
4. Identification of the user
4.1. As an identifier of the User, an e-mail address and/or telephone number provided when purchasing the Ticket is used.
4.2. A request from the telephone number/e-mail address left when purchasing the Ticket allows BUSLIO to identify the User as the rightful Party to the Agreement with corresponding rights and obligations, and allows actions in relation to both the Agreement as a whole and specifically the purchased Ticket.
4.3. The User’s request from another telephone number and/or e-mail address provided when purchasing the Ticket gives BUSLIO the right to require the User to additionally identify themselves as the proper party to the Agreement.
4.4. In case of inability to identify the User, as a party to the Agreement, BUSLIO reserves the right to refuse to consider the request.
4.5. Responsibility for storage and/or access to the telephone number and/or e-mail address lies with the User.
5. Ticket return conditions
5.1. Compulsory refund of Ticket funds:
5.1.1. In the event the Provider notifies about the cancellation of the route, for one reason or another, BUSLIO refunds the Funds received as payment for the Ticket, by which they were received in the amount of 100% of the Ticket value, or if available, offers to purchase another Ticket for the route of the same or another Provider.
5.2. The cost of the Ticket for a route of another Provider may differ.
5.3. Voluntary return:
5.3.1. In case of processing a return of the Ticket, at the User’s own initiative, BUSLIO returns the money to the user based on the data of the automated calculations of the return of funds provided by the Provider;
5.3.2. The return conditions for each Provider’s Ticket differ in accordance with internal rules;
5.3.3. BUSLIO’s agent remuneration and the Service fee, in case of voluntary return of the Ticket, are not subject to refund;
5.3.4. The Ticket purchased by the User for promotional and/or discounted fares, including when using a code that grants the right to a discount, are returned on conditions of 100% withholding from the Ticket price.
5.4. Funds or a part of Funds, provided that mandatory withholdings are deducted, when returning the Ticket directly through the Website, are transferred to the User within 10 days after sending the last route of the order and/or the decision accepted by the Provider and/or BUSLIO, regarding the refund to the User of funds, by an analogous method to the receipt of the funds.
5.5. In case of disagreement by the User, with the amount that is returned or subject to return, the decision regarding the amount of such return is made exclusively by the Provider.
5.6. Resolution of the Cabinet of Ministers of Ukraine No. 176 dated 18 February 1997 “On approval of the rules for the provision of passenger road transport services”, regulates ticket returns exclusively to the ticket office of the Bus Station, and also does not cover the concept of Provider, in accordance with the terms of the Agreement.
5.7. Ticket return procedure:
5.7.1. The User submits a return request exclusively through their personal account on the Website, describing in detail the situation or providing supporting information (evidence) when submitting a request for return through their personal account.
5.7.2. Methods of processing/submitting a Ticket return request by the User:
- Option A. The User authorizes on the Website using the phone number, which was provided during the order;
- Option B. The User follows the return link provided along with the Ticket received by e-mail (specified during the order) immediately after the order payment;
5.8. In case when the User is unable to use one of the communication options provided in clause 5, thereby providing BUSLIO with the possibility to identify themselves as the rightful user, BUSLIO reserves the right to refuse to consider such a request for the purpose of ensuring the safety of our Users/Passengers.
5.9. In case if the User’s request consists not only in returning the money for the order, then this is regarded as a claim and is submitted by the client in an official form in accordance with the Law of Ukraine "On Citizens’ Appeals".
6. Compensations
6.1. In exceptional situations BUSLIO has the right to return the full cost or part of the Ticket value to the User, without agreeing the refund amount with the Provider. Such return is made at the expense of BUSLIO’s own funds.
6.2. BUSLIO does not compensate the cost or part of the Ticket value purchased by the User, for the purpose of reaching the transfer point or the final destination purchased, both on the Website and on another website.
7. Conditions for providing information
7.1. To complete the booking and purchase of the Ticket on the Website it is necessary to provide the following information: the Name and Last Name of the passenger (document number by which they can be identified is established optionally by the Provider), a valid e-mail address and a phone number.
8. Warranties of the parties
8.1. By making a purchase through the Website, the User confirms, their legal capacity and consents to the processing of their personal data.
8.2. The User agrees to pay the Ticket price and the corresponding taxes for all purchases made, paid by credit or debit cards or another permitted method of payment.
8.3. The User agrees to pay all funds defined by BUSLIO in case the payment is not made, returned or rejected by the User’s bank.
8.4. BUSLIO, when selling the Ticket via the Website, confirms that it has the right to sell this Ticket, in accordance with the terms and obligations determined by the Provider.
9. Confidential information
9.1. The User confirms consent to the fact that they bear personal responsibility for the confidential information provided for storage.
9.2. BUSLIO is not responsible for any losses caused as a result of unauthorized use of the confidential information left by the User.
9.3. All personal information obtained by BUSLIO as a result of placing orders through the Website is stored in accordance with the provisions on confidentiality, which are an integral part of the Agreement.
9.4. BUSLIO reserves the right to use and disclose information about the User or about an order made by the User, on the terms of compliance with Confidentiality.
9.5. In order to protect business interests, BUSLIO provides a response to a written request “On provision of information about the Provider”, received at the address BUSLIO with mandatory prior notice and receipt of permission from the Party in relation to which the request is made, including and through requests from relevant government or other bodies authorized by law to obtain such information.
9.6. BUSLIO reserves the right to change the rules of Confidentiality at any time, exclusively in the direction of improvement, with further expansion of the terms of storing confidential information.
10. Consent to processing personal data
10.1. The User provides consent and confirms that the data provided by them when purchasing the Ticket is truthful, and the User has the right to enter it when buying the Ticket and leave it for further processing and storage, including, but not limited to, for:
10.1.1. transferring them to a third party, which is in one way or another related to this Agreement, or for the purpose of its full execution;
10.1.2. additional informing of the User, about the status of the route execution, changes in its terms;
10.1.3. further processing of the User’s orders;
10.1.4. receipt of service messages, including regarding promotions, bonus programs and discounts carried out by BUSLIO.
11. Liability of the parties
11.1. In the event of failure to perform or improper performance by one of the Parties of obligations under the Agreement, the guilty Party is obliged to compensate the other Party for losses caused and proven by such actions.
11.2. The User personally bears responsibility for compliance with the terms and rules of the selected Provider and this Agreement.
11.3. The User bears sole responsibility due to the inability to provide reliable information, including information about the person on whose behalf they act within the scope of this Agreement, including, but not limited to, the inability to use personal information on the Website, without any exceptions, in the including, but not limited to, in case of absence of reliable personal information from the User.
11.4. The User agrees to reimburse losses caused to BUSLIO, and if necessary, protect the interests of BUSLIO (including, but not limited to founders, subsidiaries, affiliated companies, each of employees, directors, employees, agents, contractors and representatives against any claims, losses, expenses and obligations (including the corresponding expenses for legal assistance)), related to the performance of the terms of this Agreement.
11.5. This Agreement regulates exclusively the terms of purchase of the selected Ticket by the User, which in turn serves as evidence of the conclusion of the Transportation agreement.
12. Exemption from liability of the parties
12.1. A Party is exempted from liability for breach of the Agreement terms if it proves that this breach occurred as a result of the action or inaction of a third party.
12.2. The User understands and agrees that BUSLIO bears no responsibility for any direct, indirect, incidental and punitive losses, as well as for inconveniences associated with the execution of transportation (including, but not limited to delays of routes, cancellations of routes, missed connections of routes) or other possible problems that occurred in connection with visiting or using the Website.
12.3. BUSLIO is not responsible for errors or inaccuracies in the terms and prices from the sale of bus Tickets and other goods and services, if such are provided by the Provider.
12.4. BUSLIO is not responsible for losses and damages incurred by the User during trips to different points in the world.
12.5. The User agrees that they obtain access to goods and services, and information about bus transportation, available on the Website at their own responsibility.
12.6. BUSLIO is not responsible for actions, negligence, errors of representatives and warranties of any Provider, and/or any injuries, death, damage to property or other loss or expenses incurred as a result of use of or access to the Provider’s services and/or goods.
12.7. BUSLIO is not responsible for inconveniences and losses, received by the user as a result of the failure to provide reliable information when using the Website, if such information is provided by the Provider.
12.8. BUSLIO is not responsible for losses and/or loss of a Ticket for one or another mode of transport, for losses received by the User as a result of the bus arriving late to the point where the User was to make a transfer, including by a Ticket purchased with one order through the Website.
13. Claims and jurisdiction
13.1. The pre-claim procedure for considering requests is not mandatory.
13.2. In case of violation of the Agreement terms by one of the Parties, the other Party has the right to apply to court. The location of the court is selected in accordance with the applicable law of Ukraine.
13.3. Disputes regarding the Agreement are resolved on an individual basis.
13.4. If the relevant dispute cannot be resolved through negotiations, it is resolved in court in accordance with the established jurisdiction and venue of such dispute in accordance with the applicable law of Ukraine.
13.5. All matters regarding relations between the Parties not regulated by this Agreement are governed by the applicable law of Ukraine.
13.6. In case of violation of the terms of the transportation agreement, the terms of which (date, departure/arrival time, boarding/alighting location) stated in the Ticket are borne by the Carrier that actually performed the route.
14. Notice concerning the public offer agreement
14.1. If the User does not agree with the Public Offer Agreement they should not use the website buslio.com.
14.2. The Public Offer Agreement may be changed without prior notice. Changes to the Public Offer Agreement enter into force from the moment of their publication on the website buslio.com.
14.3. Making payment by the User is evidence of unconditional acceptance of the Public Offer Agreement and agreement with its terms.
14.4. Under no circumstances can the responsibility for the consequences, which were directly or indirectly caused by the use of information placed on the website buslio.com, be assigned to BUSLIO and be grounds for prosecution in court.
BUSLIO does not claim and does not guarantee that any file or program that can be downloaded from the website buslio.com and/or used with its help does not contain errors, viruses, defects and other factors that may damage data, as well as the user’s hardware or software.
The Website services are provided on an “as is” basis without any warranties of any kind, both express and implied. The User voluntarily waives prosecution against BUSLIO and reimbursement of possible or caused damage to the User.
Neither the Website administration nor its partners or employees guarantee uninterrupted and error-free operation of the Website, and they also do not guarantee that both the results obtained during the use of the Website will be and the accuracy and applicability of its materials.
BUSLIO bears no responsibility to the User or third parties for any possible loss related to the use of information or materials, posted on the website buslio.com.
15. Receipt and consideration of requests
15.1. Requests are received by FОP Hgyner Ersan.

15.2. Consideration of requests for services provided within the scope of the Agreement of a public offer is carried out by FОP Hgyner Ersan.
15.2.1. Consideration of requests regarding the transportation agreement, servicing of the passenger(s), is carried out by the respective carrier that provides such services. In such case FОP Hgyner Ersan sends the request received from the passenger to the address of the respective carrier.
15.3. Response to requests.
The response, based on the results of considering the request, is provided to the User by a method similar to the way it was received.
16. Final provisions
16.1. The Agreement number corresponds to the number of the Ticket purchased by the User.
16.2. The date of conclusion of the Agreement is the date of the payment, made in payment for the selected Ticket.
16.3. In all other matters not provided for by the Agreement, the Parties are guided by the applicable law of Ukraine.
