Sole Proprietor Guner Ersan, EDRPOU 2991019651, address: Ukraine, 08600, Kyiv region, Vasylkiv city, Dekabristiv street, house 166-A, guided by Article 633 of the Civil Code of Ukraine, offers an unlimited number of persons (hereinafter – User(s)) to conclude a Public Offer Agreement (hereinafter - Agreement), for the purpose of searching and/or purchasing tickets through the website buslio.com (hereinafter – Site) (hereinafter – BUSLIO).
The User may act within the Agreement on their own behalf and for their own benefit and/or on behalf of a third party and for its benefit, in which case the User acts solely within the powers granted by the third party.
BUSLIO is an integrated distributor of transportation services provided by carriers, bus stations, and third parties, hereinafter referred to as Supplier.
A ticket (including an electronic ticket) is a travel document of a specified form, which entitles the passenger to receive transportation services for bus transport, created in the BUSLIO automated system, sent to the email address specified during the order or otherwise issued to the User.
The ticket number is the number of the public offer agreement and the number of the passenger transportation agreement.
The User and BUSLIO are aware of the general requirements for concluding Agreements, compliance with which is necessary for the validity of the transaction, possessing full civil capacity and civil legal capacity, having the appropriate authority to conclude such a transaction, fully realizing the meaning of their actions and in accordance with the free will that corresponds to the internal will of the participants of this transaction, aiming for the actual occurrence of legal consequences, understanding the legal nature of this transaction, as well as their rights and obligations under the Agreement, in accordance with current legislation, have concluded this Agreement as follows:
1. Subject of the Agreement
1.1. Under the Agreement, BUSLIO provides services for searching for the appropriate Supplier, according to the date, time, and direction chosen by the User, forming connections of different Suppliers, concluding a transportation agreement (by selling/purchasing a Ticket), issuing tickets from different Suppliers in one order, pre-sale of tickets, booking seats, ordering a ticket by phone, reissuing a ticket, searching for the optimal schedule at the User's request, as well as prepayment for the Ticket with funds received from the User (hereinafter - Services).
1.2. For the Services provided, BUSLIO receives a fee, which consists of the amount of funds included in the cost of the Ticket and defined as Agency Fee (paid by the Supplier) and Service Charge (paid by the User).
1.3. BUSLIO, acting as an agent, on behalf of, at the expense of, and in the interests of the Supplier, through the website, sells bus passenger transportation (hereinafter - Ticket), special offers, discounts, and provides information from the Supplier.
1.4. Each purchase of a Ticket from a specific Supplier is subject to the rules and conditions of that Supplier and is an integral part of the Agreement.
1.5. In the case of purchasing several Tickets in one order, the rules and conditions of one or another Supplier may differ.
1.6. Non-compliance with the rules and conditions of the Supplier and/or BUSLIO may result in the cancellation of orders and denial of access to the Site and/or purchased services, including the possibility of using the Ticket, without refunding the funds spent on its purchase.
1.7. The purchase of a Ticket by the User on preferential terms (free transportation, etc.) in accordance with the legislation of Ukraine, is carried out exclusively at the box office/office of the respective Supplier, or with the permission of the respective Supplier.
2. Rights and Obligations of the Parties
2.1. The User has the right:
2.1.1. To receive services under the Agreement;
2.1.2. To use the Ticket, in accordance with the chosen date, time, place of departure, and chosen Supplier;
2.1.3. To return the Ticket, under the conditions defined by the Supplier and/or BUSLIO;
2.1.4. To demand compensation for damages incurred from the conditions of the Agreement, by sending a corresponding request to BUSLIO.
2.1.5. In the case of moral harm to the User, caused by the actions or inaction of BUSLIO, the amount of compensation, if proven and justified, may not exceed the amount greater than the cost of the Ticket.
2.1.6. The User, when Suppliers require to exchange and/or return the ticket exclusively at the bus station box office without the possibility of a refund, through the website or in the office of BUSLIO's partner, where the payment was made, adheres to the conditions of such exchange and/or return specified in the Ticket.
2.2. The User is obliged to:
2.2.1. Make a prepayment for the Ticket, at 100% of the cost indicated on the website;
2.2.2. Check the date, time, city/place of departure, city/place of arrival immediately after purchasing the Ticket;
2.2.3. Arrive at the place of departure in advance;
2.2.4. Notify BUSLIO about the impossibility of using the Ticket for one reason or another;
2.2.5. Familiarize themselves with the conditions for returning the Ticket;
2.2.6. Contact BUSLIO before the payment of the Ticket, in case of absence of the return conditions for the purchased Ticket of the chosen Supplier on the Site.
2.2.7. When purchasing a Ticket from two or more Suppliers or to the transfer point, through the Site, the User is obliged to independently determine the sufficient amount of time for making the transfer, including if such boarding is offered on the Site. The recommended number of hours of waiting at the transfer point is, for domestic flights 4 hours, for international 8 hours from the scheduled arrival time.
2.2.8. Familiarize themselves with the rules and conditions of the chosen Supplier before purchasing the Ticket from the chosen Supplier, thereby providing consent to comply and act in accordance with the rules and conditions of the Supplier. Some Suppliers provide the opportunity to determine the return conditions of a certain ticket only after its purchase. Based on this specificity, the User agrees that the retention upon the return of such a ticket may equal 100% of the ticket price, even if the return is processed within the first minutes after its payment.
2.3. BUSLIO has the right:
2.3.1. To act on behalf of the Supplier, within the powers defined by contractual relations;
2.3.2. To conclude a transportation agreement between the User and the Supplier, under the conditions and in the manner defined by the Supplier;
2.3.3. To establish and receive additional remuneration from the User, for additional services and/or benefits.
2.3.4. BUSLIO has the right to record telephone conversations with the User and/or Passenger, in case of contacting BUSLIO and/or in case of servicing the User/Passenger and/or the need to inform the User/Passenger and/or obtain additional information regarding any Ticket made through the BUSLIO service and/or Site.
2.4. BUSLIO is obliged to:
2.4.1. Notify the Supplier about the purchased Ticket, and additional services paid by the User;
2.4.2. Send the User the Ticket according to the form established and accepted by the Supplier;
2.4.3. Transfer the funds received from the User, as payment for the Ticket, to the Supplier's settlement account;
2.4.4. Notify the User about changes in the conditions of service provision (provided that the Supplier notifies about such changes);
2.4.5. Notify the User about changes or cancellations of the flight (in case such information is received from the Supplier);
2.4.6. Accept requests from the User, consider them independently or forward them for consideration to the relevant Supplier;
2.4.7. Timely inform the User about the consideration of the request, and in case of sending a request to the Supplier about the results of its consideration (in case such a response is received at BUSLIO's address).
2.5. BUSLIO provides a response to the request in a manner similar to its receipt. Sending a response to a third party (including at the request of the User) will not be carried out.
3. Settlements
3.1. Funds received from the User, in payment for the Ticket belong to the Supplier (except for the BUSLIO Service Charge (in case it was included in the cost of the Ticket). BUSLIO conducts settlements for the Ticket purchased by the User under the conditions and within the timeframes defined by the Supplier.
3.2. The User is solely responsible for all commission expenses and other defined bank charges that may be added to the price of the Ticket or additional services, by the issuer of the credit or debit card, except in cases, where the expenses are attributed to the responsibility of BUSLIO.
3.3. Banking services related to the transfer of funds within the Agreement are paid by the Party that carries them out.
4. User Identification
4.1. The User's identifier is the email address and/or phone number provided when purchasing the Ticket.
4.2. A request from the phone number/email address left when purchasing the Ticket allows BUSLIO to identify the User as the proper Party to the Agreement with the corresponding rights and obligations, and allows to carry out actions regarding both the Agreement as a whole and the specific purchased Ticket.
4.3. A request from the User from another phone number and/or email address provided when purchasing the Ticket gives BUSLIO the right to require the User to additionally identify themselves as the proper party to the Agreement.
4.4. In case of inability to identify the User, as a party to the Agreement, BUSLIO reserves the right to refuse to consider the request.
4.5. The responsibility for the preservation and/or access to the phone number and/or email address lies with the User.
5. Ticket Return Conditions
5.1. Forced Refund for the Ticket:
5.1.1. In case of notification by the Supplier about the cancellation of the flight, for one reason or another, BUSLIO will refund the Funds received as payment for the Ticket, by the means by which they were received in 100% of the value of the Ticket, or if available, offers to purchase another Ticket for the flight of the same or another Supplier.
5.2. The cost of the Ticket for the flight of another Supplier may differ.
5.3. Voluntary Return:
5.3.1. In the case of processing the return of the Ticket, at the User's own initiative, BUSLIO refunds the funds to the user based on the automated calculations of the refund provided by the Supplier;
5.3.2. The return conditions of each Supplier differ according to internal rules;
5.3.3. The Agency Fee and the BUSLIO Service Charge, in the case of voluntary return of the Ticket, are non-refundable;
5.3.4. Tickets purchased by the User at promotional and/or discounted rates, including when using a code that grants a discount, are returned on the terms of 100% retention of the Ticket price.
5.4. Funds or part of the Funds, subject to mandatory deductions, when returning the Ticket directly through the Site, are transferred to the User within 10 days after the last flight from the order and/or the decision accepted by the Supplier and/or BUSLIO, regarding the refund to the User, by a means similar to the receipt of funds.
5.5. In case of disagreement by the User with the amount refunded or subject to refund, the decision regarding the amount of such refund is made exclusively by the Supplier.
5.6. The Resolution of the Cabinet of Ministers of Ukraine No. 176 dated February 18, 1997 “On Approval of the Rules for Providing Passenger Automobile Transport Services” regulates the issue of returning the Ticket exclusively to the box office of the Bus Station, and also does not cover the concept of Supplier, in accordance with the conditions of the Agreement.
5.7. Ticket Return Procedure:
5.7.1. The User submits a request for a return exclusively through the personal account on the Site, detailing the situation or providing accompanying information (evidence) when submitting the return request through the personal account.
5.7.2. Ways to process/submit a request for the return of the Ticket by the User:
- Option A. The User logs into the Site using the phone number, which was provided during the order;
- Option B. The User follows the return link provided along with the Ticket, received via email (provided during the order) immediately after payment of the order;
5.8. In case the User is unable to use one of the options for contacting provided in paragraph 5, thereby providing BUSLIO the opportunity to identify themselves as the proper user, BUSLIO reserves the right to refuse to consider such a request for the safety of our Users/Passengers.
5.9. In case the User's request involves not only the refund of funds for the order, it is considered a claim and submitted by the client in official form in accordance with the Law of Ukraine “On Citizens' Appeals”.
6. Compensation
6.1. In exceptional situations, BUSLIO has the right to refund the full cost or part of the cost of the Ticket to the User, without agreeing on the refund amount with the Supplier. Such a refund is made at the expense of BUSLIO's own funds.
6.2. BUSLIO does not compensate the cost or part of the cost of the Ticket purchased by the User, for the purpose of reaching the transfer point or final destination, purchased both on the Site and on another website.
7. Conditions for Providing Information
7.1. To process and purchase a Ticket on the Site, it is necessary to provide the following information: First Name and Last Name of the passenger (the document number by which they can be identified is established optionally by the Supplier), a valid email address, and phone number.
8. Guarantees of the Parties
8.1. By making a purchase through the Site, the User confirms their legal capacity and consents to the processing of their personal data.
8.2. The User agrees to pay the price of the Ticket and the applicable taxes for all purchases made, paid by credit or debit cards or other permitted payment methods.
8.3. The User agrees to pay all amounts defined by BUSLIO in case the payment is not made, refunded, or declined by the User's bank.
8.4. BUSLIO, in selling the Ticket through the Site, confirms its right to sell this Ticket, in accordance with the terms and obligations defined by the Supplier.
9. Confidential Information
9.1. The User confirms their agreement that they bear personal responsibility for the provided confidential information.
9.2. BUSLIO is not responsible for any damages, caused by the unauthorized use of confidential information left by the User.
9.3. All personal information received by BUSLIO as a result of orders made through the Site is stored in accordance with the provisions on confidentiality, which are an integral part of the Agreement.
9.4. BUSLIO reserves the right to use and disclose information about the User or about orders made by the User, under the conditions of maintaining Confidentiality.
9.5. In order to protect business interests, BUSLIO responds to a written request “For Providing Information about the Supplier,” received at BUSLIO's address with mandatory prior warning and obtaining permission from the Party regarding which the request is made, including requests from relevant state or other bodies authorized by law to obtain such information.
9.6. BUSLIO reserves the right to change the rules of Confidentiality at any time, exclusively for improvement, with subsequent expansion of the conditions for maintaining confidential information.
10. Consent to the Processing of Personal Data
10.1. The User gives consent and confirms that the data provided by them when purchasing the Ticket is truthful, and the User has the right to provide them when buying the Ticket and leave them for further processing and storage, including, but not limited to, for:
10.1.1. transferring them to a third party, which is in one way or another related to this Agreement, or for the purpose of its full execution;
10.1.2. additional informing the User about the status of the flight execution, changes in its conditions;
10.1.3. further processing of the User's orders;
10.1.4. receiving service messages, including regarding promotions, bonus programs, and discounts conducted by BUSLIO.
11. Liability of the Parties
11.1. In case of non-fulfillment or improper fulfillment by one of the Parties of obligations under the Agreement, the guilty Party is obliged to compensate the opposite Party for the damages caused and proven by such actions.
11.2. The User personally bears responsibility for compliance with the conditions and rules of the chosen Supplier and this Agreement.
11.3. The User bears sole responsibility, in connection with the inability to provide accurate information, including about the person on behalf of whom they act within this Agreement, including, but not limited to, the impossibility of using personal information on the Site, without any exceptions, including, but not limited to, in case the User does not have accurate personal information.
11.4. The User agrees to indemnify damages caused to BUSLIO, and if necessary, to defend the interests of BUSLIO (including, but not limited to, founders, subsidiaries, affiliated companies, each of the employees, directors, staff, agents, contractors, and representatives from any claims, damages, costs, and liabilities (including relevant legal expenses)), related to the fulfillment of the terms of this Agreement.
11.5. This Agreement regulates exclusively the conditions for the purchase of the chosen Ticket by the User, which in turn is evidence of the conclusion of the Transportation agreement.
12. Exemption from Liability of the Parties
12.1. The Party is exempt from liability for violation of the conditions of the Agreement if it proves that this violation occurred due to the action or inaction of a third party.
12.2. The User understands and agrees that BUSLIO is not liable for any direct, indirect, incidental, and punitive damages, as well as for inconveniences related to the execution of transportation (including, but not limited to, flight delays, flight cancellations, missed connections) or other possible problems that occurred in connection with visiting or using the Site.
12.3. BUSLIO is not responsible for errors or inaccuracies in the terms and prices for the sale of bus Tickets and other goods and services, if such are provided by the Supplier.
12.4. BUSLIO is not liable for losses and damages, incurred by the User while traveling to various points around the world.
12.5. The User agrees that accessing goods and services, and information about bus transportation, available on the Site is at their own risk.
12.6. BUSLIO is not responsible for actions, negligence, errors of representatives and guarantees of any Supplier, and/or any injuries, death, property damage, or other loss or expenses incurred as a result of using or accessing the services and/or goods of the Supplier.
12.7. BUSLIO is not liable for inconveniences and losses, incurred by the user as a result of not providing accurate information when using the Site, if such information is provided by the Supplier.
12.8. BUSLIO is not liable for damages and/or loss of a ticket for any mode of transport, for damages incurred by the User as a result of the bus being late to the point where the User was to make a transfer, including purchased in one order through the Site.
13. Claims and Jurisdiction
13.1. The claims procedure for considering requests is not mandatory.
13.2. In case of violation of the conditions of the Agreement by one of the Parties, the opposite Party has the right to go to court. The location of the court is chosen in accordance with current legislation of Ukraine.
13.3. Disputes regarding the Agreement are resolved individually.
13.4. If the relevant dispute cannot be resolved through negotiations, it is resolved in court according to the established jurisdiction and jurisdiction of such a dispute in accordance with current legislation of Ukraine.
13.5. All issues regarding the relations between the Parties that are not regulated by this Agreement are governed by current legislation of Ukraine.
13.6. In case of violation of the conditions of the transportation agreement, the conditions of which (date, time of departure/arrival, boarding/alighting place) are specified in the Ticket, the Carrier that actually performed the flight is liable.
14. Disclaimer of the Public Offer Agreement
14.1. If the User does not agree with the Public Offer Agreement, they should not use the site buslio.com.
14.2. The Public Offer Agreement may be amended without prior notice. Changes to the Public Offer Agreement take effect from the moment of their publication on the site buslio.com.
14.3. The User's payment is evidence of unconditional acceptance of the Public Offer Agreement and agreement with its terms.
14.4. Under no circumstances shall the liability for the consequences, which directly or indirectly resulted from the use of information posted on the site buslio.com, be attributed to BUSLIO and be grounds for legal action.
BUSLIO does not represent and does not guarantee that any file or program that can be downloaded from the site buslio.com and/or used through it, does not contain errors, viruses, defects, and other factors that may harm data, as well as the hardware or software of the User.
The Site's services are provided on an “as is” basis without any warranties, either express or implied. The User voluntarily waives the right to legal action against BUSLIO and compensation for any possible or caused damage to the User.
Neither the Site administration nor its partners or employees guarantee uninterrupted and error-free operation of the Site, nor do they guarantee that the results obtained during the use of the Site will be accurate and applicable.
BUSLIO is not liable to the User or third parties for any possible damages related to the use of information or materials, posted on the site buslio.com.
15. Acceptance and Consideration of Requests
15.1. Acceptance of requests is carried out by Sole Proprietor Gyuner Ersan.

15.2. Consideration of requests for services provided under the Public Offer Agreement is carried out by Sole Proprietor Gyuner Ersan.
15.2.1. Consideration of requests regarding the transportation agreement, passenger service(s), is carried out by the relevant carrier providing such services. In this case, Sole Proprietor Gyuner Ersan sends the request received from the passenger to the address of the relevant carrier.
15.3. Response to the request.
The response, based on the results of the request consideration, is provided to the User in a manner similar to its receipt.
16. Final Provisions
16.1. The Agreement number corresponds to the number of the Ticket purchased by the User.
16.2. The date of the Agreement is the date of payment made, for the chosen Ticket.
16.3. In all other matters not provided for by the Agreement, the Parties are guided by current legislation of Ukraine.
